Terms of Service

PLEASE READ THIS ENTIRE AGREEMENT CAREFULLY. IT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR ACCESS AND USE OF THE MASSTEXTING PLATFORM, AS DEFINED BELOW. THESE TERMS AND CONDITIONS REQUIRE YOU TO ARBITRATE ANY DISPUTES YOU HAVE WITH US AND YOU WAIVE THE ABILITY TO BRING CLAIMS AGAINST US IN COURT, TO HAVE ANY DISPUTE HEARD BY A JUDGE OR JURY, OR TO BRING ANY CLAIMS AGAINST US IN A CLASS ACTION FORMAT.

These Terms of Service (the "Terms") are the sovereignty upon the individual, company, and or organization that purchases and uses MassTexting.us services (also known as "you", "your" or "Customer" in these terms of service). These include the use of text messages, and multimedia messages (MMS) available throughout www.masstexting.us (including both the mobile and web versions), any text message, or MMS long codes or shortcodes that may be provided to you according to your use of the services or the site.

If you wish to use MassTexting.us and its services, or even access the site, please read these entire terms of service carefully. These also include any possible links in these terms. These terms of service are a legally bound agreement between you and us. They may and will affect legal rights and obligations to both parties.

By using or continuing to use MassTexting.us include all the services offered currently or in the future, you agree to be legally bound by these terms and any additional terms, or terms that are added in the future or amended.

MassTexting.us provides services of notification and messaging to paid subscribers through its platform. It allows its paid customers to send information to their database as part of mobile text messaging services and mobile communication systems.

Once you purchase your account to the platform, you can begin sending text marketing campaigns as part of advertising your products or services. Moreover, you can use it to send information alerts, reminders, notifications, confirmations, and more. MassTexting.us further provides several tools to collect names and numbers, email addresses, and other information. The tools help to increase opt-ins. Please be aware that you can only acquire data if your user has given you prior express consent for receiving certain kinds of messages from you.

MassTexting does not generate, initiate, or send messages on its own for you. The user is responsible for setting up and sending messages through our platform at its discretion in subject to these terms.

MassTexting.us does not allow sending messages that are unsolicited, spam, or unwanted (please read our Anti-Spam policy). MassTexting.us does not approve of sending messages to anyone that violate the laws of the United States or these terms.

By using or continuing to use our site and services, you agree to our privacy policy, anti-spam policy, and terms of service. Moreover, you agree that you will only send text messages and MMS to people that have given you prior express consent and have full knowledge of the type of messages, frequency of messages, and have the option to opt-out.

Furthermore, you agree to claim full responsibility and accept all legal consequences (if any) upon any action taken by anyone using your account.

MassTexting.us reserves the right to suspend or terminate your account at any time, without any prior notice or warning. Furthermore, on suspension or termination, you may not be liable for a refund if your account activity is against the law of the United States or any of the terms in these terms of service.

Violation of the anti-spam law of MassTexting.us or United States laws may result in third-party legal actions against you where MassTexting.us will not take any responsibility.

MassTexting.us further reserves the right to terminate your access to its services and platform at any time if we have a reason to believe that your activity is harmful to MassTexting.us

We reserve the right to delete any or all data store in your account immediately following the suspension or termination of your account. These include text messages, MMS, long codes, shortcodes (including all kinds of numbers provided), keywords, and/or other services or tools provided. We reserve the right to assign Keywords to other users.

1. Terms of purchase of the services

A. General purchase terms
To use and purchase the services of MassTexting.us, you must be at least 18 years of age or the legal age of maturity in your jurisdiction where you will be using the service. Upon the purchasing of our services, you will require a valid credit/debit card with the following information (unless another payment arrangement is made which will specifically be mentioned at the time)

1. Your name is on the card
2. Card number
3. Card type
4. Date of expiration of the card
5. Activation numbers or codes needed to charge the amount to your card

Submitting this information implies that you agree that you authorize us or the third-party credit card processor service to charge your card at our convenience within 30 days of authorization. You can choose the service(s) that you want to order from us and you agree to pay the price applicable at the time of the purchase (including any sales tax and other surcharges). MassTexting.us or the third-party credit/debit card processes will bill your card (or another form of payment) as part of the order processing.

B. Duration of subscription and termination
Your subscription to MassTexting.us and all its services is available over the platform from the date of your payment for a subscription is received by us (unless there is a free trial offer). Your chosen subscription will continue to be active for the length of the terms that are mentioned when you purchase it. If there is no time length specified, then a monthly basis will be considered until the customer cancels the subscription (details below).

If a customer chooses to cancel a subscription in the middle of the duration of the subscription, the customer shall NOT be entitled to a refund for the unused part or the remainder of the subscription package.

MassTexting reserves the right to terminate these terms and suspend a customers' usage access to their subscription to the services (with written notice) on the following conditions

1. If the customer fails to pay us any amount due
2. If the customer fails to follow any of the terms or conditions mentioned in these terms of service

MassTexting.us reserves all rights to terminate these terms and effective immediately suspend your access to the services or suspend services due to nonpayment. These include the decline of your card or payment method for any reason. We further reserve the right to immediately shut down the account, delete the stored data, and take back the provided Keywords and assign them as we please.

C. Trial account/promotional offers
MassTexting.us may offer promotional offers such as trial subscriptions to access services for free for a limited time, or discounted prices for a limited time.

If you sign up on a trial use account at MassTexting.us, you will have limited rights and access to the platform and services. Such a trial account shall be terminated or renewed on the terms of the trial of the time or any other terms discussed. Please know that when you sign up for a free trial, you may require to provide your credit card number along with verification from us unless specified.

When we process your card, some companies may temporarily hold your account for your first payment. We are not responsible, please contact your card company for questions.

Please be aware that MassTexting.us is not liable to provide price protection or refunds in the event of a change in pricing or promotional prices.

D. Renewal of membership automatically
MassTexting.us will automatically renew your subscription to the platform and services at the end of the subscription term continuously and indefinitely. This can be changed by selecting the option to stop. The membership or subscription fee once charged shall not be refunded.

If you renew your package before time, then certain subscriptions allow you to roll over the previous credits. However, if you renew your package after the expiration time, your previous remaining credits will expire and you agree to forfeit them.

If you do not renew your subscribed package on time, then the remaining credits, and all data including Keywords will be expired and taken back and removed.

MassTexting.us reserves all rights to change the pricing of the current package at any time. In case of a pricing change, new prices will be posted on the pricing page and an attempt to notify you will be made via email. If you do not accept the pricing, you can cancel your subscription. If you do not take the action, it will be considered that you consented to the new pricing.

In case of an error in your invoice, please mention it within 60 days at help@masstexting.us. If you do not do it in the allotted time, you agree that you are not entitled to demand a dispute.

E. Cancelation or termination of the subscription
MassTexting.us gives the right to the customer/subscriber to cancel their subscription any time using the settings available in their account. Cancellation of the subscription means you agree to forfeit the remainder of the utilities in your package. This does not imply if we have specified a 30-day moneyback guarantee.

To avoid getting a late cancellation fee or to avoid giving up your renewal fee, you should cancel your subscription near the end of the current subscription package duration. Upon cancellation or nonpayment, the customer will lose all access to the data in their account. These include assigned keywords, text message or MMS shortcodes, long codes, and other numbers. These can henceforth be assigned to new users as we please. However, if the customer owns their dedicated number then we shall not take ownership of the number.

MassTexting.us reserves the right to terminate your account if there is any suspicious activity including sending spam messages, or restricted content (as mentioned below). Moreover, if your payment methods are declined and your payment is due, we may terminate or suspend your account.

F. Payment
MassTexting.us accepts all payments made through credit or debit card or another payment method that we may mention when you sign up. We may choose to accept any mode of payment including cash in the future. You should have all legal authorization to use the card you will use on MassTexting.us.

MassTexting.us will never be responsible for any unauthorized payments billed to your car by a third party.

By adding your payment options, you agree to pay all fees and charges included in the purchasing of any subscription including taxes and fees of all sorts. If we do not receive payment from the card issuer, you agree to pay all amounts upon demand by MassTexting.us.

G. Refund
All purchases and transactions that you make with MassTexting.us are subject to the refund policy of the time. Currently, MassTexting.us offers no refunds for any subscriptions purchased through the platform.

H. Price Adjustment
MassTexting.us is at sole discretion to make changes or amendments in the pricing at any time. We do our best to describe all prices in the most accurate way possible. However, if we make a human error, we shall have the right to cancel orders. If we charged your card, we will reverse the charge.

2. Warranty

MassTexting.us depends on mobile network operators (MNOs). If there is a delivery issue of a time-sensitive or otherwise message, we bear no loss or responsibility for it.

3. Keywords, ownership, and limited license

A. Keywords
When you use our site to create a text message or MMS campaign, you may have the option to select and create a new and unique keyword for your use. You can use the keyword as long as you are subscribed to our service. However, you do not own the keyword in any way, shape, or form. MassTexting.us reserves the right to change the keyword assigned to you at any time. We may provide you with an alternate keyword in a time like this.

Furthermore, MassTexting.us reserves the right to reclaim any keyword at any time for any reason. Including those keywords that have not been used in the past thirty days.

MassTexting.us reserves all rights to the use of keywords.

B. Ownership
The site including all past, present and future versions, the content on the website, numbers, and keywords are controlled and owned solely by MassTexting.us.

All property is fully owned by MassTexting and we have the right to make changes and amendments as we please.

C. Limited License
During the subscription to the MassTexting.us packages, you may be assigned numbers and keywords. These are owned by MassTexting.us and can be revoked at anytime subject to any violation/cancellation.

However, if you own a dedicated shortcode and use MassTexting.us as a platform, we will not take ownership of your shortcode.

4. Service Use Restrictions

A. Platform Restrictions
By using MassTexting.us, you agree that you will

1. Not engage in any activity that may harm this platform or individuals associated with this platform
2. Never be unlawful, abusive, offensive, obscene, or any other way objectionable to MassTexting.us or its representatives
3. Never reverse engineer or disassemble the platform source code
4. Never engage in any activity that causes interference in user access to the platform
5. Never interfere with any security feature of the site
6. Never attempt to gain ownership to MassTexting.us
7. Never sell, resell, or sublicense to anyone
8. Never intentionally use the site for any illegal activities
9. Never violate our anti-spam policy
10. Never violate these or any other terms added in the future.

In case of breach of any of these terms or ones added in the future, you shall be responsible for the action taken against you.

B. Content Restrictions
By using MassTexting.us you agree that

1. You will not monitor, store, or distribute the content on this site
2. You will not use any framing techniques to enclose any content
3. You will keep note of all the copyright material and content
4. You will not make any changes to the content
5. You will not exploit the content of MassTexting.us in any way

Furthermore, by using MassTexting.us, you agree that the content that you send out to your subscribers will not be racist, politically offensive, obscene, pornography, lewd, harassing, misleading, immoral, harmful, vulgar, abusive, or otherwise objectionable of any sort.

C. Availability of Services
MassTexting.us has all the rights to immediately suspend or terminate the availability of its services on its site at any time as a whole or in parts at any time for any reason. We are at the sole discretion of this and are not liable to send a prior notice.

D. Reservation of Rights
These terms and all additional terms in the future and present include only a limited grant of rights to content to use the site and platform. No right or license should be taken as any legal authority by implication, custom, or otherwise. All rights expressed are solely reserved by MassTexting.us and our decision shall be final. Any unauthorized use of the content, the site, the platform, or the services for any purpose is strictly prohibited. You agree that if you do not follow these terms, we may take strict legal action against you.

5. Support and customer service

MassTexting.us makes all reasonable efforts to make the platform available 24 hours a day and seven days a week. However, this may differ in case of planned downtime, any unavailability caused by anything beyond our control which includes acts of God, acts of government, strikes, or failure of the internet service provider. If you have any questions, you may contact us at help@masstexting.us.

By approaching MassTexting.us for help, you agree that customer support is at our sole discretion and we have no obligation to provide you with any support.

6. Notification of changes

These terms of service may be changed or amended at any time. While we will try our best to send our users/clients notice of an update, we are not bound or liable to send it. Any changes or amendments will be posted on this page and will be therefore applicable as soon as they are live.
